III. STATE COLLEGE BOROUGH WATER AUTHORITY (SCBWA) PROPOSED TEXT AMENDMENT
On May 25, 2017, the State College Borough Water Authority (SCBWA) submitted an application
proposing changes to both Chapter 26 (Stormwater Management) and Chapter 27 (Zoning). The proposed
text amendment included any form of “Essential Service” to be permitted as a Conditional Use by the
Board of Supervisors. After further Planning Commission review at the June 26, 2017 meeting,
Planning Commission members requested the SCBWA to revise the proposed text amendment and frame it
specifically to a Water Treatment Facility. The Commission felt that the proposed text amendment
was too broad and could be problematic for other “Essential Services." Gwin, Dobson & Foreman have
provided a letter along with revised text language for the Planning Commission’s consideration
specific to “Water Production Facilities” instead of “Essential Services."
Staff Recommendation: The Planning Commission take time to review and comment on the revised
ordinance text amendment and make a recommendation to the Board of Supervisors on the proposed
Zoning Ordinance Text Amendment.
IV. HARNER FARM REZONING REQUEST – ZONING MAP AMENDMENT
On May 10, 2017, Ferguson Township Department of Planning & Zoning received a copy of the Rezoning
Application and Rezoning Request Map from Aspen Whitehall Partners, LLC, on behalf of Danny R. and
Pamela M. Harner and Thompson P. Harner and Nancy P. Harner. The Planning Commission initially
reviewed the proposal and heard public comment at the June 12, 2017 meeting. The Planning
Commission tabled action until staff performed further analysis on the proposal. Since the June 12,
2017 meeting, staff has met with the applicants and formulated a comprehensive land use analysis
and summary recommendation for the Planning Commission’s consideration.
Staff Recommendation: The Planning Commission review and recommend to the Board of Supervisors the
proposed Zoning Map Amendment.
V. FERGUSON TOWNSHIP EMAIL UTILIZATION POLICY FOR AUTHORITIES, BOARDS AND COMMISSIONS
The purpose of this policy is to establish expectations of conduct by which email users shall abide when utilizing Township email accounts, as well as to ensure compliance with governing statutes including the PA Sunshine Act, PA Right to Know Law, and other applicable local, state, and federal law. The Township Manager directed staff to provide the Resolution, adopted by the Board of Supervisors on July 3, 2017, and the associated policy for the Planning Commission members to review. Acknowledgement Form coincides with the policy and must be signed by all members.
Staff Recommendation: The Planning Commission review the Ferguson Township Email Utilization Policy
and Sign the Acknowledgement Form.
