Wellhead Protection Zoning Area Overlay District and Model Ordinance

On July 7, 2015, the State College Borough Water Authority (SCBWA) and Ferguson Township Supervisors conducted a joint meeting to discuss the Cottages PRD submission and discussed policy recommendations on future developments located within wellhead protection areas. One of the policy recommendations that had been discussed at the joint meeting was the development of a new Wellhead Protection Zoning Area Overlay District which corresponds to the delineated SCBWA Zones 1, 2 and 3.  Dave Yoxtheimer, PG, Hydrogeologist, AquaLith Technologies, LLC, will be in attendance for further discussion on the model ordinance.

Staff Recommendation: Staff recommends that the Planning Commission review the Wellhead Protection Zoning Area Overlay District Model Ordinance for further discussion. 

Removal of Child Daycare /Preschool from Prohibited Uses in the Terraced Streetscape District

On February 17, 2016, Mr. and Mrs. Robert and Rachel Johnson filed a Zoning Ordinance Amendment Application for the Board of Supervisors to consider removing Child Daycare and Preschools from the list of Prohibited Uses in the Terraced Streetscape District under §27-703.2.F. Prohibited Uses, (6) Child daycare/Preschool. At the Board of Supervisors meeting held on Monday, March 7, 2016, members voted to forward the application for a proposed ordinance amendment to the Planning Commission for further consideration.

Staff Recommendation: Staff recommends that the Planning Commission review, comment and make recommendation on the requested Zoning Amendment Application.

Proposed Zoning Amendment – Assisted Living Facilities at Turnberry “Crossings at State College”

At the January 25, 2016 meeting of the Ferguson Township Planning Commission, members heard a presentation from representatives from the company Smith/Packett regarding the allowance of Personal Care Home and Assisted Living Residences within the Traditional Town Development Zoning District.  At that meeting, the Planning Commission made a motion to recommend this change to the zoning ordinance. Since that time, staff has prepared a Draft Amendment, which was reviewed by the Centre Regional Planning Agency (CRPA), the Centre Regional Planning Commission (CRPC) and Joe Green, Township Solicitor. Staff has also included a revised General Master Site Plan of Turnberry TTD for the Planning Commission’s consideration.

Staff Recommendation: The Planning Commission review and make a recommendation to the Board of Supervisors to adopt the Amendment.  In addition, make a recommendation for the Board of Supervisors to consider and determine whether or not the changes are substantial enough to require a modification to the approved Turnberry General Master Plan prior to the submission of a specific implementation plan.

REFarm Café & J.L. Cidery and Winery

This Plan, submitted by Penn Terra Engineers, Inc. is proposing to develop a 2,500 ft. Farm Café and a 2,600 ft.2 Cidery and Winery located at 3392 Shingletown Road. In June of 2015, the Board of Supervisors adopted an amendment to the Zoning Ordinance to allow Farm Cafes as a Conditional Use within the Rural Agricultural (RA) Zoning District.

Staff Recommendation: The Planning Commission review and make recommendations on both the Conditional Use and Land Development Application.

State College Alliance Church

This Plan, submitted by Uni-Tech Consulting Engineers, Inc. is proposing a 21,933 ft. addition to its existing building which is approximately 21,836 ft.2.  Stormwater, Parking, and Lighting will all be addressed again as part of this new Land Development submission.

Staff Recommendation: The Planning Commission review and make recommendations on both the Conditional Use and Land Development Application.
